FLOW YACHT CREW Terms & Conditions FOR CANDIDATES

A.   Definitions:

FLOW Yacht Crew or we: the consultancy company.

Candidate or you: the person/crew member introduced by FLOW Yacht Crew to the client for a job interview.

Client: the person or corporative entity to which the candidate is introduced and potentially hired which also may be the registered owner of the yacht.

Yacht: the vessel/property which constitutes the place of employment.

MLC: Maritime Labour Convention (2006).

LNM: Spanish “Ley de Navegación Marítima” (2014).

   B.   Status of the consultancy company

FLOW Yacht Crew is a mediatory party between the client and the candidate being therefore not able to guarantee the employment. We do not undertake to employ you upon your registration.

C.   Employment protection statement

1)   Non-discrimination

FLOW Yacht Crew is an equal opportunity consultancy company. We will not discriminate and will take affirmative action measures to ensure against discrimination in employment, recruitment, advertisements for employment, compensation, termination, upgrading, promotions, and other conditions of employment against any employee or job applicant on the bases of race, gender, nationality, religion, disability, sexual orientation, or age.

2)   Accuracy of the information

You undertake to provide us with authentic and fair records that represent your job experience, qualifications, medical status, etc. That information will be processed in accordance with our published Privacy Policy. In any case, you are responsible for maintaining your details up-to-date. Please note we will be assessing your requirements to work on a ship in accordance with the MLC 2006 (Title 1):

3)   Non-fee policy

No candidate will be charged for registering or being represented by the consultancy company. The client will afford the fees incurred during the recruitment process.

4)    Complaints

Our commitment is to offer the best recruiting services to our registered crew. However, we do understand sometimes things do not go as expected and, for such reason, we will be pleased to address any compliant received from our candidates, rectify and improve our services as required. You can report your complaint at victoria@flowyachtcrew.com.

Under the Spanish regulations, you are also entitled to escalate this and file your complaint to the competent marine authorities: Dirección General de la Marina Mercante according to the Real Decreto 357/2015.

5)    Confidentiality

Your candidate details will NEVER be passed onto a third party who is not a client of the consultancy company without your explicit consent, unless there is a legal obligation to do so. Your personal details are processed in accordance with our GDPR-compliant Privacy Policy.

6)   Crew member rights

Pursuant to the application of the MLC you have the right to work under some legal conditions as set out in its Title 2 which are aimed to ensure that seafarers have a fair employment agreement. Please find relevant information regarding those conditions on the provided link below.

FLOW Yacht Crew will ensure its clients comply with the requirements above although the clients, as employers, are solely responsible for their job postings and the final employment agreement particularly offered and signed with every candidate.

D.   Endeavours

These T&C shall be governed by and constructed in accordance with the Law of Spain and all disputes arising in connection with them shall be submitted to the exclusive jurisdiction of the Courts of Palma de Mallorca.
